Carmel in February-April 1993 are hereby directed to deliver such materials to the Clerk of the U.S. District Court, Western District of Texas. While the Clerk shall be the custodian, the U.S. Marshal's service shall be responsible for the physical transfer of the materials presently in the custody of the Texas Rangers..... While custody of all of the materials will be in the Clerk of the Court, the U.S. Marshal's services will have responsibility for the security of the materials and the supervision of access which may be hereafter allowed by the Court.... Ordered, to reiterate the Court's previous Order of August 9, 1999, that all agencies or individuals having possession or custody of any items seized as a result of the search warrant attempted to be executed on February 28, 1993; any items recovered from the Mt. Carmel Compound on or after February 28, 1993; any items prepared by the Government as exhibits for the criminal trial, whether offered or admitted or not; all exhibits admitted during the trial; all agents' reports and other documents; all photographs, audio and video tapes and transcripts of the same evidence (including those recently seized from the Hostage Rescue Team of the F.B.I.); and any other items or documents in any way relevant to the events occurring at Mt. Carmel in February - April, 1993 are hereby directed to deliver such materials to the Clerk of the U.S. District Court, Western District of Texas by October 1, 1999 or James William Blagg, the U.S. Attorney for the Western District of Texas, shall appear personally at 10:00 a.m. on that day and explain why he and the United States should not be held in contempt of Court. Ordered that all evidence currently in the care, custody or control of the Government shall be maintained in its current state prior to its transfer to the Clerk of the Court. Any party that destroys, alters or otherwise tampers with any evidence related to the Branch Davidian criminal or civil litigation will be considered in contempt of court, with the resulting punishment to be determined by this Court. Ordered that the Clerk of the Court send copies of this Order to the relevant parties by facsimile transmission and by certified mail, return receipt requested, to the following: James William Blagg, U.S. Attorney for the Western District of Texas; Attorney General Janet Reno; F.B.I. Effective September 10, 1999, Eric Holder, the Deputy Attorney General, has recused the U.S. Attorney's Office for the Western District of Texas "from and/all matters and pertaining to any/all matters relating to the 1993 Siege of the Branch Davidian Compound near Waco, Texas", "[t]hese matters include, but are not limited to: the criminal appeals and/or post conviction challenges related to the events occurring at the Branch Davidian Compound on or after February 1993; the wrongful death claims resulting from these events; pending or future requests for information under the Freedom of Information Act (FOIA); and any and all other inquiries or investigations by any federal, state, or local agency or authority into the events occurring at the Branch Davidian Compound between February and April 1993; and any events relating to this matter which have occurred since April 1993."
